Please review these Terms of Service carefully before creating a workspace or using Tanda. By registering an account, redeeming an invite code, or using our back-of-house operations web platform, you agree to be bound by these terms.

1. Service Scope & Business Purpose

Tanda provides a web-based, multi-tenant software-as-a-service (SaaS) application engineered exclusively for commercial kitchens, culinary groups, and hospitality operators. The service encompasses menu dish engineering, recipe costing, product supplier registries, inventory batch tracking (FEFO/FIFO), production list whiteboard coordination, and operational scheduling.

2. Workspaces, Staff Accounts & Security

Workspace Owners: The user who registers a workspace is the primary administrative authority with rights to manage team permissions, invite codes, financial formula settings, and workspace deletion.
Staff Members: Users joining via invite codes agree to act solely within their authorized operational permissions granted by the workspace owner.
Credential Safeguards: You are responsible for maintaining the confidentiality of your authentication credentials, OTP codes, and biometrically enrolled devices.

3. Important Food Safety & HACCP Disclaimer

Tanda is a digital operational assistant and recordkeeping tool. While the platform enables tracking of expiration dates, storage locations, delivery reception temperatures, and food label photographs, the platform does not inspect, test, or certify the actual physical safety or hygiene of any food products.

The restaurant operator, food business operator (FBO), and designated food safety supervisor retain sole and non-delegable legal responsibility for complying with all applicable national and European Union food hygiene laws, including but not limited to Regulation (EC) No 178/2002 (General Food Law), Regulation (EC) No 852/2004 (Hygiene of Foodstuffs), and local HACCP regulations.

Tanda shall not be liable for food spoilage, contamination, consumer illness, allergen mislabeling, inventory loss, or regulatory penalties resulting from inaccurate manual entries, hardware thermometer inaccuracies, or kitchen operational failures.

4. AI Food Label Scanner & Optical Verification

The platform offers an optional optical AI tool to extract LOT numbers, expiration dates, and weights from food packaging photographs.

Because packaging labels may be obscured, creased, or low-contrast, users must inspect and verify all extracted data side-by-side with the photograph before confirming a delivery intake. Staff always retain the full capability to enter, modify, or override any field manually while preserving the photograph as an audit proof.

5. Intellectual Property & Tenant Data Ownership

Your Proprietary Data: All recipes, ingredient formulas, dish compositions, pricing models, supplier agreements, and internal kitchen notes created within your workspace remain the exclusive intellectual property of the workspace owner. Tanda claims no ownership over your operational recipes or trade secrets.

Platform Intellectual Property: The Tanda software, user interface design, PQL bulk dish parser, algorithms, brand tokens, and documentation are owned exclusively by Tanda and protected by intellectual property laws.

6. Acceptable Use & Security Obligations

You agree not to:

Attempt to bypass tenant isolation, reverse engineer APIs, or probe for vulnerabilities.
Exceed rate limits through automated scrapers or denial-of-service scripts.
Upload malicious payloads, viruses, or non-label photographic files into storage buckets.
Share or resell workspace access to unauthorized third parties without permission.

7. Workspace Deletion & Termination

A workspace owner may terminate their subscription and permanently delete their workspace at any time in Settings > Workspace > Danger Zone.

Upon deletion, all database records (recipes, dishes, batches, suppliers, categories) and storage bucket files are permanently erased in compliance with GDPR Article 17.

8. Limitation of Liability & Applicable Law

To the maximum extent permitted by applicable law, Tanda provides the service on an "AS IS" and "AS AVAILABLE" basis. Tanda disclaims all warranties, express or implied, including fitness for a particular purpose.

In no event shall Tanda be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues. These terms shall be governed by and construed in accordance with the laws of the European Union member state where Tanda operates.
